In these Terms, "we," "us," and "our" mean Ipanema Wellness Center LLC. "You" means any person who visits this website, books an appointment, makes a purchase, or receives services from us.
2. Acceptance of These Terms
By accessing this website, booking an appointment, purchasing a service or product, or subscribing to our communications, you agree to these Terms of Service and to our Privacy Policy, available at https://www.ipanemawellness.com/privacy-policy
If you do not agree with these Terms, please do not use this website or our services.
3. Eligibility
You must be at least 18 years old to book services, make purchases, or submit information through this website. Treatments are provided only to adults aged 18 and over, or to minors accompanied by a parent or legal guardian who provides written consent.
4. Our Services
Ipanema Wellness Center provides aesthetic and wellness spa services, which may include body treatments and body contouring, facial and skin care treatments, beauty treatments, laser hair removal, and permanent makeup and micropigmentation.
Service descriptions, availability, and pricing on this website are provided for general information and may change without notice. The definitive description of any treatment, including its suitability for you, is the one given during your in-person consultation.
5. Appointments, Cancellations, and No-Shows
Appointments may be booked through our online booking system, by phone, or by message. Booking requests are confirmed by us. A submitted request is not a confirmed appointment until we confirm it.
Consultations
An initial evaluation or consultation has a fee of $50. This amount is applied toward the cost of your treatment if you proceed with one.
Deposits
A deposit is required to secure your appointment:
$50 for any standard treatment
$500 for Cryomodeling treatments
Your deposit is applied toward the total cost of your treatment. It is not an additional charge.
Cancellation window
We require at least 48 hours' notice to cancel or reschedule an appointment. Notice may be given by phone, SMS, WhatsApp, or through our booking system.
Late cancellations and no-shows
If you cancel with less than 48 hours' notice, or do not show up for your appointment, your deposit is forfeited in full and is non-refundable.
This applies to all deposits, including the $500 Cryomodeling deposit. Please make note of this amount before booking.
We enforce this policy because appointment time is reserved exclusively for you, and late cancellations cannot be filled.
Late arrival
If you arrive late, we may need to shorten your treatment so that other clients are not affected, or reschedule it. A shortened treatment is charged at full price. If we must reschedule due to your late arrival, our late cancellation policy applies.
Changes made by us
If we need to cancel or reschedule your appointment for any reason, your deposit is fully protected. You may reschedule at no cost or receive a full refund of the deposit, at your choice.
6. Pricing, Purchases, Packages, and Gift Cards
All prices are in U.S. dollars and do not include applicable taxes unless stated.
We reserve the right to correct pricing errors, including after an order has been submitted. If a price is corrected, you may cancel the affected order for a full refund.
Payments are processed by a third-party payment provider. We do not store your card details.
Treatment packages and series
Packages and treatment series expire twelve (12) months from the date of purchase. Sessions not used within that period are forfeited.
Packages are non-transferable unless we agree otherwise in writing.
Gift cards
Gift cards cannot be exchanged for cash except where required by law, and are subject to applicable Florida law.
Refunds
All sales are final. We do not offer refunds on treatments, packages, or services.
This includes:
Treatments that have already been performed
Unused sessions remaining in a purchased package
Deposits forfeited under our cancellation policy (Section 5)
Our services are personal, performed by appointment, and reserve time that cannot be recovered. Results vary between individuals, and a result that differs from your expectation is not grounds for a refund. Please review Section 7 carefully before purchasing.
If you are unhappy with your experience, we want to hear from you. Contact us directly and we will work with you toward a fair resolution, which may include a corrective session or an adjustment to your treatment plan at our discretion.
Exceptions: Nothing in this section limits any right to a remedy that you have under applicable Florida or federal consumer protection law, or in the event of an adverse reaction, injury, or failure to provide a service that was paid for. This no-refund policy applies to ordinary dissatisfaction and to changes of mind. It does not apply where we have failed to deliver a service or where our negligence has caused you harm.

Consultation is required. Certain treatments are not appropriate for everyone. Contraindications may include pregnancy or breastfeeding, certain medical conditions, certain medications, recent procedures, or specific skin conditions.
You agree to disclose accurate and complete health information before any treatment. Withholding relevant medical information may make a treatment unsafe, and we are not responsible for adverse outcomes resulting from information you did not disclose.
If you have a medical condition or any concern about whether a treatment is right for you, consult your physician before booking.
8. Informed Consent
Before certain treatments, you will be asked to review and sign a treatment-specific consent form describing the procedure, expected sensations, aftercare requirements, and known risks. Signing that form is a condition of receiving those treatments. These Terms do not replace those consent forms.
9. Communications
By providing your email address or phone number, you consent to receive communications from us relating to your inquiry, appointment, or purchase. This includes confirmations, reminders, changes, and responses to your messages.
You will receive promotional emails or text messages only if you have opted in. You may withdraw that consent at any time, by using the unsubscribe link in any marketing email, by replying STOP to any text message, or by contacting us directly. 10. Acceptable Use of This Website
You agree not to:
Use this website for any unlawful purpose
Attempt to gain unauthorized access to any part of the site, its servers, or connected systems

Submit false, misleading, or fraudulent information, including booking appointments you do not intend to keep
Copy, reproduce, or republish our content without written permission
Interfere with the normal operation of the website
We may suspend or refuse service to anyone who violates these Terms.
11. Intellectual Property
All content on this website, including text, photographs, graphics, logos, the Ipanema Wellness Center name and logo, page design, and layout, is owned by Ipanema Wellness Center LLC or used under license, and is protected by U.S. and international copyright and trademark law.
You may view and print pages for your own personal, non-commercial use. Any other use, including reproduction, distribution, modification, or commercial use, requires our prior written permission.

12. Client Photographs and Testimonials
We photograph treatment results only with your prior written consent, given through a separate photo release form. You may withdraw that consent for future use at any time by contacting us in writing, although we cannot always recall materials already printed or distributed.
If you submit a review, testimonial, or comment about us, you grant us permission to publish it, in whole or in part, alongside your first name and last initial, unless you tell us otherwise.
13. Third-Party Links and Services
This website links to and integrates with third-party services, including our booking platform, payment processor, social media profiles, and mapping services. We do not control those services and are not responsible for their content, availability, terms, or privacy practices. Your use of them is governed by their own terms.
14. Disclaimer of Warranties
This website is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

15. Limitation of Liability

Our total aggregate liability arising out of or relating to your use of this website shall not exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim.

Claims relating to the performance of treatments are governed by applicable Florida law and by the consent forms you sign, not by this section.

You agree to indemnify and hold harmless Ipanema Wellness Center LLC and its owner, employees, and contractors from any claims, damages, losses, or expenses, including reasonable attorneys' fees, arising from your violation of these Terms, your misuse of this website, or your failure to disclose accurate health information prior to treatment.
17. Governing Law and Venue
These Terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or your use of this website shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the jurisdiction of those courts.
18. Severability and Entire Agreement
If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force.
These Terms, together with our Privacy Policy and any treatment consent forms you sign, constitute the entire agreement between you and Ipanema Wellness Center LLC regarding your use of this website.
Our failure to enforce any provision does not waive our right to enforce it later.

We may update these Terms at any time. The revised version takes effect when posted on this page, and the "Last updated" date will reflect the change. Your continued use of the website after changes are posted constitutes acceptance of the revised Terms.
